Almost every parent hears the number, even if they don’t know what it is. Somewhere in the first minutes after a baby is born, a nurse or doctor calls out a score — “Apgars were 3 and 7” — and it goes into the chart before most families have caught their breath. When the birth was frightening, when the baby was slow to cry or had to be resuscitated, that pair of numbers takes on enormous weight in a parent’s memory. Years later, a mother can still recite them.
The Apgar score is genuinely useful, but it is also one of the most misunderstood numbers in all of newborn medicine — and much of what families read online overstates what it can prove. A low Apgar score is not, by itself, a diagnosis of oxygen deprivation, and it is not proof of malpractice. A normal Apgar score is not proof that nothing went wrong. This is a plain-English guide to what the score actually measures, what the leading obstetric and pediatric bodies say it can and cannot establish, and where a low score fits — honestly — in a birth-injury question.
What Is the Apgar Score, and What Does It Measure?
The Apgar score is a rapid, standardized check of a newborn’s condition in the first minutes of life. It was created in 1952 by Dr. Virginia Apgar, an anesthesiologist who wanted a simple, repeatable way to judge whether a newborn needed help. Her name later became a memory aid for the five signs it grades: Appearance (color), Pulse (heart rate), Grimace (reflex response), Activity (muscle tone), and Respiration (breathing effort).
Each of the five signs is scored 0, 1, or 2, so the total runs from 0 to 10. The score is assigned at 1 minute and again at 5 minutes after birth. Crucially, if the 5-minute score is below 7, the American College of Obstetricians and Gynecologists (ACOG) and the American Academy of Pediatrics (AAP) recommend that scoring continue — every 5 minutes, up to 20 minutes — and be recorded on an expanded reporting form alongside what resuscitation was being given at each interval. That later series is not a formality. As the minutes pass, the trend of the score — whether the baby is recovering or staying depressed — carries far more meaning than any single reading.
What the Apgar score measures, in plain terms, is how the baby is doing right now and how well the resuscitation is working. It is a bedside impression, not a laboratory value. That distinction is the key to everything that follows.
What Counts as a Low Apgar Score?
A score of 7 to 10 is considered reassuring; 4 to 6 is moderately low; and 0 to 3 is low. A reassuring score means the baby generally needs only routine care. A moderately low score usually means the baby needs some help — stimulation, oxygen, clearing the airway. A low score means the baby needs active resuscitation.
But the single most important threshold in the medical literature is not the 1-minute number that parents remember most vividly. It is a score below 5 that persists at both 5 and 10 minutes. A depressed 1-minute score is common and often means very little — many perfectly healthy babies need a moment to get going. A score that is still low at 5 minutes, and lower still at 10, is the pattern that obstetric and neonatal experts treat as meaningful. This is why the later scores, and whether anyone bothered to record them, matter so much.
The 10-minute Apgar is the one that is most often missing. When a delivery is chaotic and a team is focused on resuscitating a baby, the expanded scoring beyond 5 minutes is easy to skip in the record even when the baby clearly remained depressed. A chart that documents a 1- and 5-minute Apgar but goes silent after that — on a newborn who needed ongoing resuscitation — leaves a gap exactly where the most clinically important information should be.
Does a Low Apgar Score Mean My Baby Was Deprived of Oxygen?
Not on its own. This is the single most important thing for a worried parent to understand, and it is where a great deal of online content gets it wrong. In Committee Opinion No. 644, “The Apgar Score” (2015, since reaffirmed) — a joint statement of ACOG and the AAP — the guidance is explicit: the Apgar score alone cannot be considered to be evidence of, or a consequence of, asphyxia, and it is inappropriate to use the Apgar score alone to establish the diagnosis of oxygen deprivation.
The reason is that many things unrelated to a lack of oxygen can push the score down. Prematurity lowers muscle tone and reflexes regardless of oxygenation. Maternal medications and anesthesia can leave a baby sleepy and slow to breathe. Infection, certain birth defects, and the mechanics of a difficult delivery can all depress a score in a baby whose oxygen supply was never the problem. A number that can be moved by so many factors cannot, by itself, prove why it was low.
To connect a low Apgar score to genuine oxygen deprivation, clinicians look for objective evidence — above all, umbilical cord blood gas results. A low umbilical artery pH and an elevated base deficit are laboratory measurements of whether the baby’s tissues were actually starved of oxygen during labor, and they don’t depend on anyone’s bedside judgment. This is precisely why ACOG recommends that whenever a baby scores 5 or less at 5 minutes, the care team should draw umbilical arterial blood gases and send the placenta for pathological examination. Does a Low Apgar Score Mean My Baby Will Have Cerebral Palsy?
In the great majority of cases, no. ACOG Committee Opinion No. 644 is careful here in a way that many websites are not. It confirms that Apgar scores below 5 at both 5 and 10 minutes clearly confer an increased relative risk of cerebral palsy, and that the risk rises the longer the score stays abnormal. But in the same breath it states the counterweight: most infants with low Apgar scores do not develop cerebral palsy. Both facts are true at once. A persistently low score raises the statistical risk, and the individual child is still far more likely not to have cerebral palsy than to have it.
This is why the Apgar score is never used as a standalone forecast. The ACOG and AAP Neonatal Encephalopathy Task Force treats it as one element in a larger picture. Neonatal signs that are consistent with an acute event around the time of birth include an Apgar score below 5 at 5 and 10 minutes, umbilical artery acidemia, evidence of injury on MRI, and multi-organ involvement — the kidneys, liver, heart, or blood-clotting system showing the strain of the same event. It is the constellation, not the Apgar number, that supports a conclusion. A low score is a prompt to gather the rest of the picture, not the picture itself. Can a Normal Apgar Score Rule Out a Birth Injury?
No — and this is the mirror-image mistake. Just as a low score does not prove injury, a reassuring score does not prove its absence. The Apgar score is a brief, partly subjective impression taken in the first minutes of life, before a newborn injury has had time to declare itself. Some of the most serious injuries evolve over the hours after birth. A baby can post a 5-minute Apgar of 8 or 9 and, later that same day, begin to show the signs of neonatal encephalopathy — abnormal tone, a weak or absent suck, unusual irritability or lethargy, or seizures.
That evolving window is medically important because it is also a treatment window. When a term or near-term newborn shows signs of moderate-to-severe encephalopathy, therapeutic hypothermia (cooling therapy) is most effective when started within the first six hours of life. A reassuring Apgar score that leads a team to stop watching closely — and to miss the window — can matter as much as a low score that was never worked up. The lesson for parents is the same in both directions: the delivery-room number is where the story starts, not where it ends.
When Does a Low Apgar Score Point to Possible Negligence?
A low Apgar score is not evidence of malpractice. Difficult births happen in careful hands, and a depressed newborn is often the result of an event that no one could have prevented. As with every topic on this blog, the legal question is not the outcome — it is the care. A low score is simply a reason to examine, closely, what happened before and after it. The questions that tend to matter are concrete:
- Was the fetal heart rate monitoring before delivery read correctly, and was a deteriorating tracing acted on — or did a preventable emergency arrive at birth as a surprise?
- When the baby was born depressed, was resuscitation prompt, organized, and competent, with the right people present?
- Were umbilical cord blood gases actually drawn, as ACOG recommends when a baby scores 5 or less at 5 minutes — or was the one objective test of oxygen deprivation simply never obtained?
- Were the 10-minute and later Apgar scores recorded, giving an honest trend — or does the record go quiet on a baby who plainly stayed depressed?
- Was a baby with signs of encephalopathy promptly evaluated for cooling therapy and, if eligible, cooled within the six-hour window?
When the answers reveal a preventable event that competent care should have caught or answered — and a baby was seriously injured as a result — the negligence lives in that care, with the Apgar score serving only as one early marker on the timeline. When the answers show that the team monitored, recognized, and responded appropriately, a low score reflects a hard birth rather than a failure.
What a Trained Reader Looks For in the Delivery Records
Because the Apgar score is so easily over- or under-read, these cases turn on reading the whole newborn record with both medical and legal training. - The resuscitation record. What was done, by whom, and how quickly — and whether the timing matches the score the baby was given.
- The first hours of life. The nursery and neonatal notes for the evolving signs of encephalopathy, and whether a cooling evaluation was triggered while it could still help.
